We will require sight of original identification documents. We will verify your identity using online sources.

When your buyer’s lawyers confirm that they are instructed by your buyer we will send them the draft contract papers. When the contract has been approved and we have received the approved transfer deed we will liaise with you for your signature to these documents. We will hold these documents on file in readiness for exchange of contracts and completion.
If your property is leasehold or involves the services of a management company, your buyer will require additional information. We will need to obtain this information from your Landlord and/or Management Company. We will contact them to ascertain their fees and contact you to ask you to make the payment for their fees on account. We will then apply for the information and send it on to your buyer’s lawyer upon receipt.

When we receive the draft contract papers from your seller’s lawyers we will put in hand your searches. We will send the results to you as we receive them. Please be aware that, in normal circumstances, it can take 2 – 3 weeks for all search results to be returned to us. When we receive instructions from your lender and a copy of your mortgage offer (if applicable) we will write to you to let you know.

We will apply for a redemption figure from your lender for each mortgage registered against your property. We will then send this to you to check.

We will check through the draft contract papers and raise any pre-contract enquiries of your seller’s lawyer. A copy will be sent to you, usually with your preliminary report. Please let us know if you have any enquiries that you would like raised from your inspection of the property or from your surveyor’s report.

We will receive pre-contract enquiries from your buyer’s lawyers. Some of these will be legal enquiries for us to answer. Others will be about things only you can answer as the owner of the property.

We will send our preliminary report on title to you, together with a copy of the plan to the property that you are purchasing and the Fittings and Contents form completed by your seller for you to check. You will also receive a copy of the Property Information Form completed by your seller and copies of the title documents to read through.

We will reply to your buyer’s lawyer’s pre-contract enquiries. If your buyer’s lawyer requires any further information, they will raise further enquiries which we will answer with your assistance as necessary.

When we receive replies to our pre-contract enquiries from your seller’s lawyers, we will check through these to make sure they are satisfactory. If they are not satisfactory we will raise further enquiries but once all enquiries have been satisfied we will prepare our final report to you and arrange for you to sign the contract and other documentation in readiness for exchange of contracts. Ordinarily, if we have not done so already, we like to meet our client(s) at this point to discuss any matters that concern you. COVID is making this difficult at present but we can offer outside meetings and video conferencing alternatives.

When your buyer’s lawyers confirm that they are satisfied and all parties in the chain are ready, we can exchange contracts and set the completion date.

When we hold your signed documents, deposit monies (if applicable) and all parties in the chain are ready, we can proceed to exchange contracts and set a completion date. We will order the mortgage monies from your lender (if applicable) in time for the completion date. Please be aware that most lenders require at least 5 working days notice.

Contracts are exchanged! Now is the time to book your removals and make other moving arrangements for the big day. Don’t forget to put in place your building insurance policy (if you are buying) from the date of exchange of contracts and send us a copy of the policy schedule. We will obtain an up to date redemption statement from your lender(s) if you are selling.

Legal completion takes place once the monies due under the contract are received by us. We will confirm legal completion with your buyer’s lawyer and authorise the release of the keys to the estate agent. We will telephone you to let you know that the sale has completed. Whilst this may happen early on the day of completion, under the terms of the contract it is fairly standard to have until 1pm to vacate the property being sold. You must have vacated the property by this time though and left it clean and free of all rubbish. Don’t forget to take meter readings and drop off the keys to the agents!

On the day of completion we will send the monies due under the contract to your buyer’s lawyers. If you are also selling a property please bear in mind that we can only send the monies on when we have received the monies for the property you are selling from your buyer’s lawyers. When your seller’s lawyer receives the monies then they will telephone us to confirm legal completion. The buyer’s lawyer will authorise the estate agent to release the keys to your new property to you.
We will telephone you to let you know that your purchase has legally completed and the property is now all yours! Please bear in mind that whilst this may happen early on the day of completion, under the terms of the contract it is fairly standard that the sellers have until 1pm to vacate the property being sold. Please therefore do check with the estate agents that they hold the keys before making your way to collect them. When you arrive at the property it is advisable to take meter readings as soon as possible.

We still have some work to do! We will be ensuring that your mortgage(s) have been paid off, your estate agent’s commission has been settled and any monies due to you have been sent to you. We will ensure that your buyer’s lawyer has all the documents they need to be able to complete the registration of the new owner at HM Land Registry and we will assist where necessary.

We still have some work to do! We will submit the Stamp Duty Land Tax (SDLT) return to HM Revenue & Customs and pay any SDLT due on your behalf. If the property you are purchasing is leasehold or the services of a management company are involved, we will serve the necessary notices to advise that you are the new owner(s).
When we receive the seller’s transfer deed from their lawyer, we will register your ownership of the property at HM Land Registry. Once the registration process has competed and you are registered as the new owner(s) of the property we will send you copies of the updated register of title for you to keep.
